(hereinafter: Juwelier Wagner).<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">1.2  <p>Deviating terms and conditions shall not apply, and Juwelier Wagner hereby objects to such deviating terms. Any ancillary agreements will only become part of the contract if they have been confirmed in writing by Juwelier Wagner.<\/p>\n<\/li>\r\n                          <\/ol>\r\n          <\/div>\r\n        <\/li>\r\n                      <li class=\"block py-8 border-t\" x-data=\"{open: false}\">\r\n          <div @click=\"open = !open\" class=\"flex items-center justify-between h-full cursor-pointer group\">\r\n            <Div class=\"text-lg transition-colors text-333 group-hover:text-777\" :class=\"{'!text-777' : open}\">2. This consent can be revoked by the customer at any time at info@juwelier-wagner.at. <\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">2.2  <p>The customer is obliged \u2013 during the period between order and delivery \u2013 to immediately notify Juwelier Wagner of any changes to their email address or other contact details. If such notification is not made, declarations shall be deemed to have been received even if sent to the last known address.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">2.3  <p>The customer agrees to receive messages for advertising purposes from Juwelier Wagner itself or from companies commissioned by Juwelier Wagner for this purpose, in accordance with \u00a7 107 of the Telecommunications Act (TKG). This consent can be revoked by the customer at any time at info@juwelier-wagner.at. <\/p>\n<\/li>\r\n                          <\/ol>\r\n          <\/div>\r\n        <\/li>\r\n                      <li class=\"block py-8 border-t\" x-data=\"{open: false}\">\r\n          <div @click=\"open = !open\" class=\"flex items-center justify-between h-full cursor-pointer group\">\r\n            <Div class=\"text-lg transition-colors text-333 group-hover:text-777\" :class=\"{'!text-777' : open}\">3. If Juwelier Wagner cannot fulfill an order, Juwelier Wagner will notify the customer as quickly as possible.<\/p>\n<\/li>\r\n                          <\/ol>\r\n          <\/div>\r\n        <\/li>\r\n                      <li class=\"block py-8 border-t\" x-data=\"{open: false}\">\r\n          <div @click=\"open = !open\" class=\"flex items-center justify-between h-full cursor-pointer group\">\r\n            <Div class=\"text-lg transition-colors text-333 group-hover:text-777\" :class=\"{'!text-777' : open}\">4. Deliveries are made exclusively within Austria and to the other countries indicated in the webshop portal. Delivery takes place Monday \u2013 Friday. The delivery person requires a signature upon receipt of the goods. The delivery time is 2 to 5 days from receipt of order (or, for payment via \u201cSofort\u00fcberweisung.de\u201d, 2 to 5 days from the crediting of the invoice amount). Should the delivery period be extended, Juwelier Wagner will inform the customer accordingly and state the estimated delivery time, which can be up to 60 days. The customer then has the option to cancel the order free of charge.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">4.2  <p>Shipping costs and insurance during transit until the recipient&#8217;s confirmation of receipt are borne by Juwelier Wagner. Any returns by the customer (also in the event of a possible withdrawal\/cancellation according to point 6.) must be made in the same way as the shipment to the customer; in particular, the customer is obliged to also send the goods as an insured letter and to ensure equivalent insurance during transit as with the shipment to the customer. The customer shall bear the costs of returning the goods. Should the customer return the goods freight collect, Juwelier Wagner will charge the customer for the transport costs.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">4.3  <p>Returns of goods are possible in Juwelier Wagner&#8217;s sales outlets upon presentation of the original packaging, the certificate, and the original invoice.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">4.4  <p>Juwelier Wagner strives to keep delivery times as short as possible. Should delivery delays nevertheless occur, the customer waives the right to assert any claims for damages due to the delay.<\/p>\n<\/li>\r\n                          <\/ol>\r\n          <\/div>\r\n        <\/li>\r\n                      <li class=\"block py-8 border-t\" x-data=\"{open: false}\">\r\n          <div @click=\"open = !open\" class=\"flex items-center justify-between h-full cursor-pointer group\">\r\n            <Div class=\"text-lg transition-colors text-333 group-hover:text-777\" :class=\"{'!text-777' : open}\">5. Payment<\/Div>\r\n            <span>\r\n              <svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"transition-transform w-2.5 h-1.5 lg:w-6 lg:h-3\" :class=\"{'rotate-180' : open}\" viewBox=\"0 0 24.414 12.207\">\r\n                <path data-name=\"Pfad 81\" d=\"M11 0 0 11.5 11 23\" style=\"fill:none;stroke:#977d2e;stroke-linecap:round;stroke-linejoin:round;stroke-miterlimit:10\" transform=\"rotate(-90 6.207 5.5)\" \/>\r\n              <\/svg>\r\n            <\/span>\r\n          <\/div>\r\n          <div class=\"grid grid-rows-[0fr] text-base text-333 transition-[grid-template-rows]\" :class=\"{'!grid-rows-[1fr]' : open}\">\r\n            <ol class=\"overflow-hidden\">\r\n                                <li class=\"mb-4 prose first:mt-4\">5.1  <p>Goods can be paid for either by cash or with Mastercard and Visa credit cards or with the Maestro debit card. Bank payments in advance are possible, but the order numbers must be provided. <\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">5.2  <p>The goods will be handed over after the cash amount has been transferred, a positive confirmation of the credit card transaction has been received, and the full invoice amount has been credited by the seller&#8217;s bank.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">5.3  <p>Payment is due promptly without discount. In the case of a down payment, the outstanding amount must be paid within 14 days after a payment request from Juwelier Wagner. <\/p>\n<\/li>\r\n                          <\/ol>\r\n          <\/div>\r\n        <\/li>\r\n                      <li class=\"block py-8 border-t\" x-data=\"{open: false}\">\r\n          <div @click=\"open = !open\" class=\"flex items-center justify-between h-full cursor-pointer group\">\r\n            <Div class=\"text-lg transition-colors text-333 group-hover:text-777\" :class=\"{'!text-777' : open}\">6. Withdrawal \/ Cancellation<\/Div>\r\n            <span>\r\n              <svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"transition-transform w-2.5 h-1.5 lg:w-6 lg:h-3\" :class=\"{'rotate-180' : open}\" viewBox=\"0 0 24.414 12.207\">\r\n                <path data-name=\"Pfad 81\" d=\"M11 0 0 11.5 11 23\" style=\"fill:none;stroke:#977d2e;stroke-linecap:round;stroke-linejoin:round;stroke-miterlimit:10\" transform=\"rotate(-90 6.207 5.5)\" \/>\r\n              <\/svg>\r\n            <\/span>\r\n          <\/div>\r\n          <div class=\"grid grid-rows-[0fr] text-base text-333 transition-[grid-template-rows]\" :class=\"{'!grid-rows-[1fr]' : open}\">\r\n            <ol class=\"overflow-hidden\">\r\n                                <li class=\"mb-4 prose first:mt-4\">6.1  <p>If the customer is a consumer, the provisions of the KSchG apply.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">6.2  <p>For goods that are manufactured according to customer specifications or are clearly tailored to the customer&#8217;s personal needs, a withdrawal\/cancellation is excluded. This applies in particular to jewelry with personal engraving. <\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">6.3  <p>In the event of Juwelier Wagner&#8217;s consent to a withdrawal\/cancellation, the goods must be returned to Juwelier Wagner&#8217;s business premises or sent back to Juwelier Wagner as a valuable letter. In this case, Juwelier Wagner will refund the purchase price with a voucher if the goods have been received or the customer has proven the dispatch of the goods as a valuable letter. <\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">6.4  <p>In the event of a withdrawal\/cancellation, the customer has no right to compensation for the loss in value of the goods. A withdrawal can be revoked by Juwelier Wagner if, following inspection of the goods and their functionality, signs of use or other defects caused by the customer are found.  <\/p>\n<\/li>\r\n                          <\/ol>\r\n          <\/div>\r\n        <\/li>\r\n                      <li class=\"block py-8 border-t\" x-data=\"{open: false}\">\r\n          <div @click=\"open = !open\" class=\"flex items-center justify-between h-full cursor-pointer group\">\r\n            <Div class=\"text-lg transition-colors text-333 group-hover:text-777\" :class=\"{'!text-777' : open}\">7. Warranty and Usage Instructions<\/Div>\r\n            <span>\r\n              <svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"transition-transform w-2.5 h-1.5 lg:w-6 lg:h-3\" :class=\"{'rotate-180' : open}\" viewBox=\"0 0 24.414 12.207\">\r\n                <path data-name=\"Pfad 81\" d=\"M11 0 0 11.5 11 23\" style=\"fill:none;stroke:#977d2e;stroke-linecap:round;stroke-linejoin:round;stroke-miterlimit:10\" transform=\"rotate(-90 6.207 5.5)\" \/>\r\n              <\/svg>\r\n            <\/span>\r\n          <\/div>\r\n          <div class=\"grid grid-rows-[0fr] text-base text-333 transition-[grid-template-rows]\" :class=\"{'!grid-rows-[1fr]' : open}\">\r\n            <ol class=\"overflow-hidden\">\r\n                                <li class=\"mb-4 prose first:mt-4\">7.1  <p>Towards consumers, the statutory warranty provisions apply, meaning Juwelier Wagner provides a warranty for defects already present at the time of handover for 2 years from handover. In case of improper use or external force, a warranty claim is excluded.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">7.2  <p>Naturally, jewelry made from all materials offered by Juwelier Wagner will show signs of wear such as scratches and dents from the first day of wearing, caused by contact with hard materials (e.g., glass or iron). If a matte or satin-finished jewel was selected when ordering, this finish will wear off relatively quickly with wear. However, this circumstance does not constitute a defect!<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">7.3  <p>The ring size chosen by the customer is determined by the customer themselves. Fingers are subject to influences such as heat, cold, time of day, weight gain or loss, and can therefore change in circumference. This can lead to inaccuracies when measuring the size and must be taken into account when determining the ring size.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">7.4  <p>Should delivered items show obvious material or manufacturing defects, including transport damage, the customer must immediately report this to Juwelier Wagner. However, the failure to make such a complaint does not have any consequences for the existence of his statutory warranty claims, provided the customer is a consumer.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">7.5  <p>Images of watches and jewelry are not shown in original size for layout reasons and may differ in color from the original due to production reasons. Product images are merely examples, as each jewel has unique characteristics due to the precious materials used. Jewels with natural stones may vary in color, nuances, and natural inclusions.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">7.6  <p>Due to individual processing of the jewels, there may be slight deviations between the displayed carat weight of the offered items and reality; such deviations do not constitute a defect in the ordered goods.<\/p>\n<\/li>\r\n                          <\/ol>\r\n          <\/div>\r\n        <\/li>\r\n                      <li class=\"block py-8 border-t\" x-data=\"{open: false}\">\r\n          <div @click=\"open = !open\" class=\"flex items-center justify-between h-full cursor-pointer group\">\r\n            <Div class=\"text-lg transition-colors text-333 group-hover:text-777\" :class=\"{'!text-777' : open}\">8. The respective warranty conditions can be accessed when selecting a specific product or will be handed over with the goods upon delivery. <\/p>\n<\/li>\r\n                          <\/ol>\r\n          <\/div>\r\n        <\/li>\r\n                      <li class=\"block py-8 border-t\" x-data=\"{open: false}\">\r\n          <div @click=\"open = !open\" class=\"flex items-center justify-between h-full cursor-pointer group\">\r\n            <Div class=\"text-lg transition-colors text-333 group-hover:text-777\" :class=\"{'!text-777' : open}\">9. Vouchers<\/Div>\r\n            <span>\r\n              <svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"transition-transform w-2.5 h-1.5 lg:w-6 lg:h-3\" :class=\"{'rotate-180' : open}\" viewBox=\"0 0 24.414 12.207\">\r\n                <path data-name=\"Pfad 81\" d=\"M11 0 0 11.5 11 23\" style=\"fill:none;stroke:#977d2e;stroke-linecap:round;stroke-linejoin:round;stroke-miterlimit:10\" transform=\"rotate(-90 6.207 5.5)\" \/>\r\n              <\/svg>\r\n            <\/span>\r\n          <\/div>\r\n          <div class=\"grid grid-rows-[0fr] text-base text-333 transition-[grid-template-rows]\" :class=\"{'!grid-rows-[1fr]' : open}\">\r\n            <ol class=\"overflow-hidden\">\r\n                                <li class=\"mb-4 prose first:mt-4\">9.1  <p>By purchasing and\/or using Juwelier Wagner vouchers, the customer expressly accepts these General Terms and Conditions.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">9.2  <p>Juwelier Wagner vouchers can generally be redeemed in Juwelier Wagner GmbH branches for 24 months from purchase or activation.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">9.3  <p>Juwelier Wagner vouchers cannot be used as a means of payment for purchases in the online shop, but are accepted exclusively in Juwelier Wagner&#8217;s retail stores.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">9.4  <p>Gift vouchers can also be ordered in the online shop, whereby the purchase of vouchers is not subject to VAT.<br \/>\n9.5. Extension of validity: Within three years after reaching the expiry date, a one-time free extension of the voucher&#8217;s validity for another year is possible. A further extension is not possible. After a maximum of 6 years, the voucher and the credit balance on it will expire. The voucher card can then no longer be used.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">9.5  <p>Exchange \/ Cash Redemption: Juwelier Wagner vouchers are excluded from return and exchange; submitted vouchers will not be paid out in cash \u2013 with the exception of a one-time extension or a refund after the expiry date. When redeeming vouchers, cash refunds for difference amounts are not possible. The contract language is German. Austrian domestic jurisdiction is agreed upon. If it is not a consumer transaction, the exclusive jurisdiction of the court in Vienna 1 that is competent for all disputes arising from and in connection with this contract is agreed upon.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">15.2  <p>Amendments and additions to these terms require written form to be effective. Oral or written ancillary agreements are only binding on Juwelier Wagner after written confirmation. In the event of violations of these General Terms and Conditions, Juwelier Wagner reserves the right to exclude the customer from further participation without prior notice.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">15.3  <p>This contract is governed by substantive Austrian law, excluding the conflict of laws rules of international private law and the UN Convention on Contracts for the International Sale of Goods. Towards consumers in the EEA, this choice of law applies only insofar as it does not restrict mandatory statutory provisions of the state in which the consumer has their domicile or habitual residence.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">15.4  <p>Furthermore, Juwelier Wagner reserves the right to change these General Terms and Conditions at any time and without stating reasons. Such changes do not apply to orders already placed. By placing an order, the currently valid General Terms and Conditions are accepted.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose first:mt-4\">15.5  <p>Should one or more provisions of these General Terms and Conditions be invalid, this shall not entail the invalidity of the entire contract.<\/p>\n<\/li>\r\n                                <li class=\"mb-4 prose
