Terms and Conditions

The following terms apply to all contracts, deliveries, and other services provided by Juwelier Wagner Gesellschaft m.b.H. (hereinafter: Juwelier Wagner).

Deviating terms and conditions shall not apply, and Juwelier Wagner hereby objects to such deviating terms. Any ancillary agreements will only become part of the contract if they have been confirmed in writing by Juwelier Wagner.

The customer gives their consent for the personal and personally identifiable data provided by them to be processed by Juwelier Wagner with automated support and to be used for information, market research, and for the purpose of sending advertising for its own goods via postal and electronic means – including SMS. This consent can be revoked by the customer at any time at info@juwelier-wagner.at.

The customer is obliged – during the period between order and delivery – to immediately notify Juwelier Wagner of any changes to their email address or other contact details. If such notification is not made, declarations shall be deemed to have been received even if sent to the last known address.

The customer agrees to receive messages for advertising purposes from Juwelier Wagner itself or from companies commissioned by Juwelier Wagner for this purpose, in accordance with § 107 of the Telecommunications Act (TKG). This consent can be revoked by the customer at any time at info@juwelier-wagner.at.

In principle, only available goods can be selected for order.

The goods selected by customers for order will be shown with individual prices, total price, taxes, and, if applicable, shipping costs.

Juwelier Wagner reserves the right not to accept the order if an item is unavailable, if the customer has unjustifiably failed to pay invoices from previous deliveries, if credit card checks have not been successfully completed, or if there are otherwise legitimate doubts about the customer’s creditworthiness. If Juwelier Wagner cannot fulfill an order, Juwelier Wagner will notify the customer as quickly as possible.

Delivery will be made as a registered valuable letter with personal delivery exclusively to the recipient specified in the order (i.e., the customer or a third party designated by the customer). Deliveries are made exclusively within Austria and to the other countries indicated in the webshop portal. Delivery takes place Monday – Friday. The delivery person requires a signature upon receipt of the goods. The delivery time is 2 to 5 days from receipt of order (or, for payment via “Sofortüberweisung.de”, 2 to 5 days from the crediting of the invoice amount). Should the delivery period be extended, Juwelier Wagner will inform the customer accordingly and state the estimated delivery time, which can be up to 60 days. The customer then has the option to cancel the order free of charge.

Shipping costs and insurance during transit until the recipient’s confirmation of receipt are borne by Juwelier Wagner. Any returns by the customer (also in the event of a possible withdrawal/cancellation according to point 6.) must be made in the same way as the shipment to the customer; in particular, the customer is obliged to also send the goods as an insured letter and to ensure equivalent insurance during transit as with the shipment to the customer. The customer shall bear the costs of returning the goods. Should the customer return the goods freight collect, Juwelier Wagner will charge the customer for the transport costs.

Returns of goods are possible in Juwelier Wagner’s sales outlets upon presentation of the original packaging, the certificate, and the original invoice.

Juwelier Wagner strives to keep delivery times as short as possible. Should delivery delays nevertheless occur, the customer waives the right to assert any claims for damages due to the delay.

Goods can be paid for either by cash or with Mastercard and Visa credit cards or with the Maestro debit card. Bank payments in advance are possible, but the order numbers must be provided.

The goods will be handed over after the cash amount has been transferred, a positive confirmation of the credit card transaction has been received, and the full invoice amount has been credited by the seller’s bank.

Payment is due promptly without discount. In the case of a down payment, the outstanding amount must be paid within 14 days after a payment request from Juwelier Wagner.

If the customer is a consumer, the provisions of the KSchG apply.

For goods that are manufactured according to customer specifications or are clearly tailored to the customer’s personal needs, a withdrawal/cancellation is excluded. This applies in particular to jewelry with personal engraving.

In the event of Juwelier Wagner’s consent to a withdrawal/cancellation, the goods must be returned to Juwelier Wagner’s business premises or sent back to Juwelier Wagner as a valuable letter. In this case, Juwelier Wagner will refund the purchase price with a voucher if the goods have been received or the customer has proven the dispatch of the goods as a valuable letter.

In the event of a withdrawal/cancellation, the customer has no right to compensation for the loss in value of the goods. A withdrawal can be revoked by Juwelier Wagner if, following inspection of the goods and their functionality, signs of use or other defects caused by the customer are found.

Towards consumers, the statutory warranty provisions apply, meaning Juwelier Wagner provides a warranty for defects already present at the time of handover for 2 years from handover. In case of improper use or external force, a warranty claim is excluded.

Naturally, jewelry made from all materials offered by Juwelier Wagner will show signs of wear such as scratches and dents from the first day of wearing, caused by contact with hard materials (e.g., glass or iron). If a matte or satin-finished jewel was selected when ordering, this finish will wear off relatively quickly with wear. However, this circumstance does not constitute a defect!

The ring size chosen by the customer is determined by the customer themselves. Fingers are subject to influences such as heat, cold, time of day, weight gain or loss, and can therefore change in circumference. This can lead to inaccuracies when measuring the size and must be taken into account when determining the ring size.

Should delivered items show obvious material or manufacturing defects, including transport damage, the customer must immediately report this to Juwelier Wagner. However, the failure to make such a complaint does not have any consequences for the existence of his statutory warranty claims, provided the customer is a consumer.

Images of watches and jewelry are not shown in original size for layout reasons and may differ in color from the original due to production reasons. Product images are merely examples, as each jewel has unique characteristics due to the precious materials used. Jewels with natural stones may vary in color, nuances, and natural inclusions.

Due to individual processing of the jewels, there may be slight deviations between the displayed carat weight of the offered items and reality; such deviations do not constitute a defect in the ordered goods.

For some of the products in the assortment, in addition to Juwelier Wagner’s statutory warranty, there are warranties from the respective manufacturers. The respective warranty conditions can be accessed when selecting a specific product or will be handed over with the goods upon delivery.

By purchasing and/or using Juwelier Wagner vouchers, the customer expressly accepts these General Terms and Conditions.

Juwelier Wagner vouchers can generally be redeemed in Juwelier Wagner GmbH branches for 24 months from purchase or activation.

Juwelier Wagner vouchers cannot be used as a means of payment for purchases in the online shop, but are accepted exclusively in Juwelier Wagner’s retail stores.

Gift vouchers can also be ordered in the online shop, whereby the purchase of vouchers is not subject to VAT.
9.5. Extension of validity: Within three years after reaching the expiry date, a one-time free extension of the voucher’s validity for another year is possible. A further extension is not possible. After a maximum of 6 years, the voucher and the credit balance on it will expire. The voucher card can then no longer be used.

Exchange / Cash Redemption: Juwelier Wagner vouchers are excluded from return and exchange; submitted vouchers will not be paid out in cash – with the exception of a one-time extension or a refund after the expiry date. When redeeming vouchers, cash refunds for difference amounts are not possible. No replacement will be provided in case of theft, loss, illegibility, damage, or unauthorized use.

Any commercial resale is prohibited.

The prices stated are Euro amounts including statutory VAT. In countries not belonging to the EU, prices are shown without VAT. In individual cases, conversion and payment of prices in dollars is possible upon request.

Despite our best efforts, it cannot be ruled out that individual goods are priced incorrectly. Juwelier Wagner checks the prices during the processing of the customer’s order before acceptance and before the customer is charged for the payment. If an item is priced incorrectly and the correct price is higher, Juwelier Wagner will contact the customer before accepting the order to ask if they wish to purchase the product at the correct price or cancel the order. Should the correct price of a product be lower than the stated price, the lower amount will be charged without further contact.

In cases of slight negligence, all claims for damages are excluded. This does not apply to personal injury or damage to items taken for processing in the case of consumer transactions.

Insofar as Juwelier Wagner’s pages contain links to other websites on the Internet, Juwelier Wagner assumes no liability for the functionality or content of such pages.

Juwelier Wagner delivers/transfers all goods under retention of title; therefore, the goods remain the property of Juwelier Wagner until full payment of the purchase price.

Any assertion of retention of title by Juwelier Wagner does not constitute a withdrawal from the contract. In the event of goods being returned, Juwelier Wagner is entitled to charge transport and handling fees.

In the event of third-party access to the goods subject to retention of title, the customer undertakes to point out Juwelier Wagner’s retention of title to the goods.

In the event of the customer’s default in payment, the customer’s default in acceptance, or other important reasons, Juwelier Wagner is entitled to withdraw from the contract.

In the event of the customer’s default in payment, Juwelier Wagner is released from all further performance obligations and entitled to withhold outstanding services and demand advance payment or adequate security.

If the customer withdraws from the contract – without being entitled to do so – Juwelier Wagner has the choice to insist on the fulfillment of the contract or to agree to the termination of the contract; in the latter case, the customer is obliged, subject to further claims for damages, to pay a contractual penalty of 10 percent of the gross invoice amount.

The place of performance is, unless there is a mandatory legal regulation to the contrary, the registered office of Juwelier Wagner in Vienna 1. The contract language is German. Austrian domestic jurisdiction is agreed upon. If it is not a consumer transaction, the exclusive jurisdiction of the court in Vienna 1 that is competent for all disputes arising from and in connection with this contract is agreed upon.

Amendments and additions to these terms require written form to be effective. Oral or written ancillary agreements are only binding on Juwelier Wagner after written confirmation. In the event of violations of these General Terms and Conditions, Juwelier Wagner reserves the right to exclude the customer from further participation without prior notice.

This contract is governed by substantive Austrian law, excluding the conflict of laws rules of international private law and the UN Convention on Contracts for the International Sale of Goods. Towards consumers in the EEA, this choice of law applies only insofar as it does not restrict mandatory statutory provisions of the state in which the consumer has their domicile or habitual residence.

Furthermore, Juwelier Wagner reserves the right to change these General Terms and Conditions at any time and without stating reasons. Such changes do not apply to orders already placed. By placing an order, the currently valid General Terms and Conditions are accepted.

Should one or more provisions of these General Terms and Conditions be invalid, this shall not entail the invalidity of the entire contract.

Wherever “the customer” is mentioned, this term is to be understood as gender-neutral and refers equally to male and female customers.

By placing their order, the customer confirms that the email address provided is valid and that the customer can be reached at this email address.

The shopping cart will now be displayed as an order list. Here, the customer has the opportunity to make any corrections before submitting their contractual declaration. By clicking the “Order with obligation to pay” button, the customer submits a binding purchase offer for the goods listed in the order list. The confirmation of acceptance of the order – and thus the conclusion of the contract – follows upon receipt of the order at the email address provided by the customer.

Juwelier Wagner stores the order data. A printout of the order can be made electronically. The print option appears after the customer has sent the order to Juwelier Wagner by pressing the “Order with obligation to pay” button and the credit card data has been successfully verified. In addition, the customer receives the order confirmation with all provided data, including the General Terms and Conditions, the cancellation policy, and the sample cancellation form, via email.

Delivery is made as a registered insured letter with personal delivery exclusively to the recipient specified in the order (i.e., the customer or a third party designated by the customer). Deliveries are made exclusively within Austria and to the other countries indicated in the webshop portal. Delivery takes place Monday – Friday. If the customer is a consumer, the provisions of the Federal Act on Distance and Off-Premises Contracts (Fern- und Auswärtsgeschäfte-Gesetz – FAGG) apply. In accordance with the provisions of the FAGG, consumers have the right to withdraw from the contract within 14 days without giving reasons (“cancellation”). Comprehensive information on this right of withdrawal or cancellation, as well as the statutory sample cancellation form, can be accessed by clicking or will be sent to the customer by email during the ordering process together with these General Terms and Conditions. The customer shall bear the costs for returning the goods after a cancellation according to FAGG.

For goods manufactured according to customer specifications or clearly tailored to the customer’s personal needs, a withdrawal/cancellation according to the above provisions is excluded (cf. § 18 para. 1 no. 3 FAGG). This applies in particular to rings with personal engraving.

In the event of withdrawal/cancellation, the goods must be returned to Juwelier Wagner as an insured letter. In the event of withdrawal/cancellation, Juwelier Wagner will only refund the purchase price once the goods have been received or the customer has proven dispatch of the goods as an insured letter.

According to § 15 para. 4 FAGG, in the event of withdrawal/cancellation, the customer is not liable for any loss in value of the goods, as long as this loss in value is a consequence of the necessary examination of the goods and their functionality. This necessary scope of examination corresponds to the trial use that would also be customary in a retail store. Use of the goods for a longer period and/or outside the customer’s premises at the place of receipt is not permitted.
